FMCS fees are paid to BIS, the testing lab, and (where used) an in-country inspection agency, and vary by product category, applicable Indian Standard, and country of manufacture — we confirm the applicable fee once your product and facility are identified; on top of the initial certification cost, an annual licence fee and advance minimum marking fee apply for the licence to remain valid.

What is BIS FMCS Certification?

FMCS allows a manufacturing facility located outside India to obtain a BIS licence directly in its own name, rather than through an Indian importer. It is commonly used by overseas electronics, toy, and cable manufacturers exporting into the Indian market, and mirrors the ISI licensing process but with an added Authorised Indian Representative (AIR) requirement, since BIS needs a local point of contact for correspondence, complaint handling, and coordination of surveillance activity.

FMCS was created to extend BIS's quality assurance framework to overseas manufacturers directly, so Indian consumers get the same certified-quality guarantee on imported goods as on domestically manufactured ones, without forcing every shipment through a re-certification cycle at the importer level each time the distribution chain changes.

Before FMCS existed, overseas manufacturers could only access the Indian market through an Indian importer holding certification on their behalf — a structure that broke down whenever the importer relationship ended, forcing a fresh certification cycle. FMCS solved this by letting the manufacturing site itself hold the licence, which then travels with the product regardless of which Indian company is importing or distributing it in a given year.

Who Needs It

Overseas factories exporting BIS-notified products to Indian buyers
International brands wanting the certificate registered in their own company name
Sourcing agents managing multiple SKUs from a single overseas facility
Manufacturers supplying multiple Indian distributors who don't want to re-certify per distributor
Overseas factories that have lost BIS certification eligibility due to an importer relationship ending

Types & Categories

Single-site FMCS

Certification tied to one overseas manufacturing facility and its specific product line.

Multi-product FMCS

A single licensed facility certified across multiple product categories/models it manufactures.

Key Benefits

Certificate is held directly by the overseas manufacturer, simplifying multi-importer supply chains
Avoids re-certification each time the product changes Indian distributor
Signals manufacturing-level quality commitment to Indian buyers
Streamlines customs clearance since the certificate travels with the product, not the importer
Reduces long-term certification costs for factories supplying multiple Indian customers

Documents Required

  • Factory registration and business licence from the country of manufacture
  • Authorised Indian Representative (AIR) appointment letter
  • Test reports from a BIS-recognised or NABL-accredited lab
  • Quality management system documentation for the overseas facility
  • Factory layout plan and machinery/testing equipment list
  • Product technical datasheets and manufacturing process flow
  • Passport/identity details of the factory's authorised signatory

Our Process

1

AIR Appointment

An Authorised Indian Representative is appointed as the local point of contact with BIS for correspondence and surveillance coordination.

2

Factory Documentation

Overseas factory details, QC processes, and test reports are compiled and translated/formatted for BIS filing.

3

Application Filing

The FMCS application is filed on Manak Online with test reports and factory documentation.

4

BIS Factory Audit

BIS officials (or an empanelled inspection agency in that country) inspect the overseas facility's manufacturing and QC processes before certificate grant.

5

Query Resolution

We help resolve any documentation or process queries raised by BIS during scrutiny of the overseas facility's file.

6

Licence Grant & Surveillance

On approval, the FMCS licence is issued in the factory's name, with periodic surveillance audits and market sample testing thereafter.

Validity & Renewal

An FMCS licence is initially granted for one or two years, at the manufacturer's choice, and can subsequently be renewed for a further period of up to five years at a time (subject to the annual licence fee and advance minimum marking fee being kept current), with continued surveillance audits of the overseas facility, broadly mirroring the domestic ISI renewal cycle.

Penalty for Non-Compliance

Importing or selling FMCS-notified products without valid certification is an offence under Section 17 of the BIS Act, 2016 — carrying imprisonment of up to two years and a fine of not less than ₹2,00,000 for a first contravention (not less than ₹5,00,000 for subsequent contraventions), extending up to ten times the value of the goods — and exposes both the overseas manufacturer and the Indian importer/AIR to seizure of goods under Customs regulations, with the shipment potentially held indefinitely at port.

Frequently Asked Questions

Is a physical factory audit always required?

For most FMCS applications, yes — BIS conducts an on-site inspection of the overseas manufacturing unit (or arranges one through an empanelled agency in that country) as part of the certification process.

Can the AIR be changed later?

Yes, though it requires formally updating BIS records — we assist with AIR transitions without disrupting your existing licence, but recommend planning the change ahead of any pending renewal or surveillance date.

How is FMCS different from routing certification through an Indian importer?

FMCS certification belongs to the overseas manufacturer directly and survives a change in Indian distributor, while importer-held certification is tied to that specific importer and lapses if the relationship ends.

Do multiple factories under the same parent company each need separate FMCS licences?

Yes — FMCS certification is site-specific, so each distinct manufacturing facility (even under the same corporate group) requires its own licence and audit.

How long is an FMCS licence valid before the first renewal?

The manufacturer chooses an initial term of either one or two years at grant; after that, renewals can run for up to five years at a time provided the annual licence fee and advance minimum marking fee are kept current and surveillance results remain satisfactory.
