Factory License in India
The core statutory approval to operate a manufacturing facility under the Factories Act.
What is Factory License in India?
A Factory Licence, mandatory under the Factories Act, 1948, authorises a manufacturing premises employing workers with power-driven processes above the prescribed worker threshold to operate legally, covering building/layout approval, safety clearances, and annual renewal obligations administered by the state Chief Inspector of Factories.
The Factories Act exists to protect the health, safety, and welfare of factory workers โ regulating working hours, ventilation, machine guarding, sanitation, and hazard management in industrial workplaces.
The Factories Act is a central law but is administered state-by-state through each state's Directorate/Chief Inspector of Factories, which means the core threshold definitions (10+ workers with power, 20+ without) apply nationally, but the specific application process, inspection intensity, and coordination with state pollution boards vary by state. Factory licensing typically has two distinct stages โ plan/layout approval before construction or occupation of the premises, and the operating licence itself once the facility and its safety systems are in place โ so the process should begin well before a factory is fully built out, not after.
Because the licence is tied to worker count and installed horsepower, both of which can change as a business scales, the renewal cycle isn't purely a formality โ a material increase in either can shift the facility into a different compliance tier and change what documentation or clearances are expected at the next renewal.
Who Needs It
Types & Categories
Provisional/Plan Approval Licence
Approval of the building and layout plan before construction or occupation of the manufacturing premises.
Regular Factory Licence
The operating licence granted once the facility, machinery, and safety systems are in place and inspected.
Key Benefits
Documents Required
- Site/building plan approved by a licensed architect
- Land ownership or lease documents
- List of machinery and manufacturing process details
- Details of installed horsepower and proposed worker strength
- Fire and pollution NOCs, where required for the facility's category
- Stability certificate from a competent structural engineer, where prescribed for the building
- Occupier and manager details with proof of their appointment
- ESI and EPFO registration proof for the establishment
- Factory plan approval form (Form No. 1 or the state Directorate's equivalent layout-approval form)
Our Process
Plan Approval
The factory building and layout plan is submitted for approval before construction/occupation.
NOC Coordination
We coordinate fire, pollution, and other departmental NOCs required for the application.
Application Filing
The factory licence application is filed with the state Chief Inspector of Factories' office.
Inspection
An inspector visits the facility to verify machinery, safety systems, and worker-welfare arrangements against the application.
Licence Grant
Following a satisfactory inspection, the licence is granted.
Renewal Tracking
We track its annual renewal and flag any material changes in worker count or horsepower that could affect renewal terms.
Validity & Renewal
Factory licences are typically renewed annually, with the renewal fee linked to the number of workers employed and installed horsepower. Renewal applications are generally expected to be filed shortly before expiry โ commonly around 30 days ahead, though a few states (Delhi, for instance) require 60 days โ and a licence renewed after it has lapsed can attract a late fee, often around 25% of the applicable annual fee, on top of the regular renewal charge.
Penalty for Non-Compliance
Operating a factory without a valid licence, or otherwise contravening the Factories Act's provisions, is punishable under Section 92 with imprisonment of the occupier and manager for up to two years, a fine of up to โน1,00,000, or both. If the contravention continues after conviction, a further fine of up to โน1,000 per day of continued contravention applies. Where a contravention of the Act's safety provisions (Chapter IV) results in an accident, the fine is enhanced to a minimum of โน25,000 for a death and โน5,000 for a serious bodily injury.
Frequently Asked Questions
Does the factory licence need annual renewal?
Yes โ factory licences are typically renewed annually, with the renewal fee and process linked to the number of workers and installed power.
When should I apply โ before or after building the facility?
Plan/layout approval should be obtained before construction or occupation begins, since building without approval risks having to make costly changes later to meet safety and layout requirements.
What counts as a 'worker' for the threshold calculation?
The threshold generally counts anyone employed in the manufacturing process on the premises, including contract labour engaged in production activity, not only direct payroll employees.
Does a change in machinery require updating the licence?
A material change in machinery, process, or installed horsepower typically needs to be reflected in the licence records, since it can affect the safety and inspection basis on which the licence was originally granted.
Is pollution board consent required alongside the factory licence?
For most manufacturing categories, yes โ state pollution control board consent (CTE/CTO) is typically required alongside, and often coordinated with, the factory licensing process.
What happens if worker count grows beyond what the licence covers?
A significant increase in worker strength or installed horsepower beyond what was declared should be reported and reflected at renewal, since it can shift the facility's applicable fee tier and inspection scope.
Is there a penalty for renewing the licence late?
Beyond the general offence provisions under Section 92, several states separately levy a late fee โ commonly around 25% of the annual licence fee โ when a renewal is filed after the licence has lapsed, so it's worth tracking the renewal window rather than treating it as a formality.
Who is legally liable if the factory operates without a valid licence?
Section 92 makes both the occupier and the manager of the factory individually liable, not just the company as an entity โ so the named occupier/manager on record carries direct personal exposure to the fine and imprisonment provisions.
